Term and Conditions

Definitions

In these Terms and Conditions, the following terms have the meanings stated below:


Child

means the child who is registered to attend a The Learning Hub course and whose name appears on the Registration Form

Client

means the parent or guardian of a Child registered to attend an The Learning Hub course whose name appears on the Registration Form; and

“The Learning Hub” means Alphabet and or VH Whizz Kids Ltd, respective organisations in England and trading under the name of ‘The Learning Hub’.

“Payment Period” This is the period defined by The Learning Hub which is one calendar month with payment on the first day of each month and for which all child fees have to be paid.

“Deposit” This is the amount held by The Learning Hub as security to cover lack of written notice by Client in the withdrawal of their child and is only refundable at the end of July which is the academic year.

Parties etc

  • This agreement is between the Client and The Learning Neither the Client nor the Child has any direct or indirect contractual or other relationship with any other person or entity other than The Learning Hub.
  • This agreement supersedes and replaces any previous agreement(s) between the Client and The Learning


Safety

  • The Client shall, prior to the commencement of the course and at regular intervals during the continuation of the course, emphasize to the Child the importance of remaining under the supervision of the teacher at all times during class and while at the course venue. The Child should be instructed not to leave the course venue under any circumstances unless accompanied by the Client or the person nominated by the Client to deliver and collect the Child from the course
  • The Client shall ensure that he or she or, where relevant, the person with responsibility to deliver and collect the Child to and from the course venue on the relevant course date personally:
  • delivers the Child to the custody of the admin person in charge;and
  • collects the Child from the admin person in charge of the Child’scourse.


Medical conditions, medication and treatments

  • The Client shall notify The Learning Hub in writing at registration if the child suffers from any medical injury, condition (including any allergies) or disability that ought properly to be brought to the attention of The Learning Hub so that an assessment of the needs of the child can be made.
  • In the event that the child develops a medical condition (including any allergies) while attending The Learning Hub course, the Client shall inform The Learning Hub in writing in advance of the lesson so that an assessment of the needs of the Child can be made.
  • The Client shall ensure that any medication or treatment that the Child is receiving (either at the time of registration on the course or during the continuation of the course) is brought to the attention of:
  • prior to registration, or at such time during the course as the medication or treatment commences, to The Learning Hub by notice in writing; and
  • at the commencement of each lesson, to the teacher of the
  • The Learning Hub and its teachers are not trained or insured to administer medications and, accordingly, are unable to administer medications to children attending The Learning Hub courses. If required, the Client shall administer the medications having first advised The Learning Hub of the circumstances.
  • In the event that The Learning Hub is notified that a Child in a class has a food allergy (or other similar condition), the teacher will take reasonable precautions to protect that Child from exposure to the cause of the allergy (or other similar condition) but The Learning Hub cannot guarantee non-exposure.


Registration fee & Deposits

There is no registration fee charged, but a deposit of £100 per child will be secured at the time of enrolment which will only be refunded subject to Deposit Refund condition.


Refunds

  • The Learning Hub may in its absolute discretion agree to refund all or part of a Client’s course fees in the event that a Child needs to withdraw from his The Learning Hub course. Whilst any refund of fees is entirely discretionary, Clients should take note of the following and discuss their Child’s circumstances with the teacher prior to withdrawing from a course and requesting a refund of fees:
  • any refund of fees is subject to The Learning Hub being able to offer the Child’s place on the course to another student and for that “replacement” student not to be disadvantaged in any way;
  • in the event that a Child has attended part of a course, any refund of course fees will be pro-rated to take account of the lessons which the Child has already attended and the cost of any materials supplied to the Child (whether those materials were intended for use in class or at home); and
  • a £35 administration fee will be deducted from the refund amount to cover additional administration costs and management time.


Payment

All fees to be paid by the first of each month by direct debit or cash. Any fees left outstanding will lead to a breach of contract by the client and the child can forfeit their place and loss of deposit.

In the event that the Client fails to make payment on the due date(s), the Child shall not be entitled to attend the course and his or her place shall automatically be cancelled and may be allocated to another Child without further notice. Cancellation in such circumstances is without prejudice to the other remedies The Learning Hub may have against the Client in respect of such non- payment.

Where payment is made via Childcare vouchers, the payment must be received by the first day of the payment period from the Childcare Voucher provider. Childcare Payment can take upto 5 -7 working days from request by parent/guardian and can lead additional admin charges.


Cancellation, Curtailment and Non-attendance

  • The Client is assured that The Learning Hub will use its reasonable endeavors to deliver the course on the date(s) and time(s) set out in the Registration However, there may be exceptional circumstances in which it is necessary for The Learning Hub to cancel the course, for example, where a teacher becomes unwell and is unable to deliver the course or a course venue is, for some reason, no longer available. In the extremely unlikely event that a course is cancelled part way through its delivery, The Learning Hub will refund a pro rata amount of the course fee to take account of the part of the course which is not delivered and the Client’s entitlement to such a pro rata refund will be its sole remedy against The Learning Hub in these circumstances.
  • Without prejudice to and notwithstanding clause 1, at any time on or prior to the date on which the first lesson of a course is to be delivered, The Learning Hub reserves the right to cancel:
  • the course;
  • the Child’s place on the course; or
  • to elect not to deliver the course (for whateverreason)


and, in such circumstances, the Client’s only remedy against The Learning Hub shall be a refund of the payment(s) he or she has already made to The Learning Hub for such course.

  • In the event that a Child is for any reason unable to attend a class, application may be made in writing to The Learning Hub to arrange an alternative date in another class to be provided by The Learning Hub (if any). The Learning Hub shall make reasonable efforts to rearrange a Child’s class but accommodation shall at all times be subject to availability (including, for the avoidance of doubt, sufficient space, in the opinion of The Learning Hub, for the Child to attend in addition to the Childs already scheduled to attend such class). In the event that no alternative class is available, or if the Child is unable to attend an alternative class offered to the Client by The Learning Hub, The Learning Hub shall, on request, indicate the work the Child should complete at home (where possible). For safety and logistical reasons, no Child shall be admitted to an alternative class where prior arrangement has not been made with The Learning Hub.
  • In the event, a Child or Client acts or behaves verbally or physically aggressive to any other child, client or member of The Learning Hub staff, The Learning Hub has the full right to remove that child or if it’s a client than their child from The Learning Hub with immediate effect to ensure the safety of its children, its client, its


At this point, The Learning Hub has full discretion as to what refund should be offered. The minimum it will deduct is the prorate amount for lessons taken, deposit and £50 administration fee.


Deposit refund & withdrawal

All courses start from September of each year and end July of the following year. A child can be admitted after a course has started but must complete till the end of the course. Deposits are non-refund and non-transferrable if a child is withdrawn after doing part of a course and parents may lose any payments made.


Customer Satisfaction

  • In the unlikely event that you are not happy with the services provided by The Learning Hub, in the first instance please raise your concerns with the Office Manager at the first available opportunity.
  • In the event that having raised your concerns with the Office Manager and the matter has not been resolved to your satisfaction, please contact by email to the following email address providing as much information as possible about your circumstances admin@tlhgroup.co.uk. Every effort will be made to ensure that genuine concerns are properly dealt


Insurance

The Child’s personal property is not covered by the Centre’s insurance. The Centre accepts no responsibility for loss or damage to any Child’s personal property on the Centre premises.


Material and ownership

All materials provided by The Learning Hub during tuition sessions remain the property of The Learning Hub.


Non-Competition

During the period your child attends The Learning Hub, the Client or the Child shall not directly or indirectly, without written consent, engage in any activity that conflicts with a teacher’s working status/role as an employee of The Learning Hub.


Marketing

A Child’s name and achievement may be used in our marketing materials including the Child’s first name and details of educational achievements.


Personal data

  • We will store and use the personal data that you give us to:
  • provide the tuition services; and
  • inform you about similar products or services offered by The Learning
  • We may store personal data in hard or electronic form and it may be given to, or accessed by, other legal entities trading under the “The Learning Hub Group”. We will not give, or provide access to, personal data to any third party.
  • In writing, at any-time, you have full-right to have the data removed from our

     

Exclusion and Limitation of Liability

  • The Learning Hub’s maximum aggregate liability for breach of these Terms and Conditions (including any liability for the acts or omissions of its employees, consultants or agents), whether arising in contract, tort (including negligence), misrepresentation or otherwise, shall in no circumstances exceed the amount of course fees paid by the Client to The Learning Hub for The Learning Hub course(s) the Child is registered to attend.
  • Nothing in these Terms and Conditions shall in any way limit:
  • either party’s liability for death or personal injury caused by its own negligence; or
  • any liability which cannot be excluded by
  • These Terms and Conditions set forth the full extent of The Learning Hub’s obligations and liabilities in respect of the course and/or other services provided by The Learning Hub including as to its quality, the chances of a Child’s success in the examinations (which, for the avoidance of doubt, is not guaranteed by The Learning Hub) that are binding on The Learning Hub. Any other condition, warranty, or other term concerning the course or other services to be provided by The Learning Hub which might otherwise be implied in or incorporated within these Terms and Conditions, whether by statute, common law or otherwise, is hereby expressly
  • The performance of any Child in any actual examination is ultimately the sole responsibility of the Child and The Learning Hub shall not be responsible or liable for:
  • a Child failing the exam(s) or not performing in the exam(s) as expected by the Client and/or Child; or
  • any indirect or consequential loss or damage (whether relating to the circumstances provided for by clause 11.4.1 or otherwise).


Third Parties

Nothing in these Terms and Conditions is intended to give any person any right to enforce any term of these Terms and Conditions which that person would not have but for the Contract (Rights of Third Parties) Act 1999.


Variations of the Terms & Conditions of the Agreement

The offer and acceptance of a place are made on the basis that any successful Centre needs to develop and that the Centre may make reasonable changes to these Terms and Conditions on giving 30 days’ notice by email and or in writing.


Damages

Child and Client are jointly liable for any damage caused by them to Centre property, any assets and equipment.


Private Tuition Only

Where One-to-One Tuition sessions are missed, a Child will not be entitled to additional sessions to make up for the missed sessions unless at least 24 hours prior notice of intention to miss a session is given in writing to the Office Manager. Private tuition fees are payable as requested in advance for the stipulated hours booked by the Client. The Centre does not take any responsibility for entering private tuition Child for external examinations. A Deposit will be taken at enrolment.


Guarantee

We shall always endeavor to provide the best tuition and service to your child and therefore will always welcome your positive feedback so that we can continue to improve.


General

  • Any notice to The Learning Hub shall be in writing and directed to The Learning Hub, Vale Farm Sports Centre, Watford Road North Wembley, Middlesex, HA0 3HG.
  • Any notice to the Client shall be sent to the address of the Client on the Registration Form or as notified to The Learning Hub from time to time.
